New York cracks down on mystery meats From iguanas to armadillos, state inspectors confiscate illegal exotic fare NEW YORK - When a food safety inspector walked into a market in Queens, he noticed the store had an interesting special posted on its front window: 12 beefy armadillos. In Brooklyn, inspectors found 15 pounds of iguana meat at a West Indian market and 200 pounds of cow lungs for sale at another market. At a West African grocery in Manhattan, the store was selling smoked rodent meat from a refrigerated display case. An inspector quickly seized a couple pounds of it. All of it was headed for the dinner table. All of it was also illegal. Authorities say the discoveries are part of a larger trend in which markets across New York are buying meat and other foods from unregulated sources and selling them to an immigrant population accustomed to more exotic fare. State regulators have responded by stepping up enforcement, confiscating 65 percent more food through September than they did in all of 2005. ~~WAL-MART taps into MEXICOS booming (?) consumer loan market!WHAT THE? Maybe they WILL donate some fence building materials to help secure this great nation.They freaking made a gazzillion bucks on Americans and projecting the image of being ALL AMERICAN.(Hey, have you checked where most of these products are from, or some of the workers for tht matter?) hummm =^.^= ~~ Wal-Mart de Mexico, or Walmex, also said in a conference call with media that the company will initially finance its banking business with its own capital. Last week, Mexico's Treasury secretary approved the opening of five new banks, including one by Walmex, the country's largest retailer. Solorzano said he hopes the company's banking division will bring it closer to its customers, because "a large part of our clients do not have access to banking services." The bank is expected to offer basic deposits and loans, including savings accounts linked to debit cards and checkbooks. In the U.S., where Wal-Mart (nyse: WMT - news - people ) has applied for approval to establish an industrial loan corporation, a kind of industrial bank, it has been met with opposition from existing banks, unions, lawmakers, and consumer and community organizations. Wal-Mart insists it has no plans to compete with community banks and has pledged to stay out of branch banking and consumer lending. Rather, its newly chartered bank would be used to handle the 140 million credit card, debit card and electronic check payments it processes each year, the company says. In July, U.S. bank regulators decided to put on hold for six months any new approvals of such applications. Analysts at Deutsche Bank (nyse: DB - news - people ) said in a report last week: "Mexico offers an attractive potential for growth as loans only represent 13 percent of gross domestic product, in contrast to 70 percent in Chile and 32 percent in Brazil." Solorzano said the banks are also expected to boost business by bringing more people into the stores. However, he believes the banking division will not make a profit until the fourth year. Julio Bosco Gomez, the former general director of Bank One in Mexico, has been put in charge of Banco Wal-Mart de Mexico Adelante SA. In recent years, Mexican retailers have moved into retail banking to sell financial products to their mainly low-income clients. Mexico's large retail banks have typically shunned this market, in favor of lending to middle and upper income individuals and corporations. Mexican retailer Grupo Famsa plans to open Banco Ahorro Famsa, while retailer Controladora Comercial Mexicana SA (other-otc: 8363.PK - news - people ) said it will partner with a unit of French banking group BNP Paribas (other-otc: BNPZY.PK - news - people ) SA to offer consumer and credit card loans in Mexico. Grupo Elektra was the first Mexican retailer to enter banking when it opened its Banco Azteca unit in 2002, which had 17.32 billion pesos ($1.58 billion) in loans at the end of June. MARINE CORP. BIRTHDAY AND VETERANS DAY SHOUT OUT!!

Hey! As far as I know the Democrats havent done away with Veterans Day,yet, and its the Marine Corps Birthday also! Perfect timing for us wanting to say THANK YOU!To all military people,past and present and how greatful we are for the sacrifice of life,limb and family for OUR freedoms and liberties.During the past few weeks leading up 2 elections,we were carpet bombed with the notion people were SICK of the war,and its fiancial strain and body count.We even had a certain HorseFace Elitist Arogant Piece of Shit who AGAIN DISSED our brave Service Members in the spotlight.Thats all a load of pre election scare tatics,and Jeeze, it looks like it worked on some of our fellow countrymen and women.and maybe you ,yourself went in with this line of thinking.I wont judge you either way,but all thats behind us as we break out a very patriotic HAPPY BIRTHDAY MARINES! and THANK YOU VETERANS!We cant thank you enough or say how awesome you are! Our true Blue American Heros are the backbone of all we have and all we do.I still want to kiss everyone of ya and give ya a sweet hug! New law ensures remains of soldiers will be handled with respect on trip home POST FALLS -- John and Stacey Holley can finally move on and grieve the loss of their son, Matthew, who was killed in Iraq. The Post Falls parents' 10-month battle for a federal law that ensures the remains of fallen soldiers are handled with respect while being transported home has become reality. "I am relieved that this mission is complete," John said Tuesday. "This has been a big responsibility to see this through to the end. "It was like riding the biggest roller coaster of your life. At first, you are apprehensive about your decision to get on, but once on, you are committed to the end. When it's all over, you are glad you did it." Matthew, who was born in Post Falls, was a 21-year-old Army specialist assigned to the 1st Battalion, 320th Field Artillery Regiment, 101st Airborne Division, Fort Campbell, Ky. He was killed by a roadside bomb on Nov. 15. The Holleys said they were horrified when they found out their fallen soldier son's remains were going to be handled by baggage carriers at the San Diego airport. If it hadn't been for last-minute string pulling by their military casualty assistance officer with U.S. Sen. Barbara Boxer, D-Calif., they said their son, Matthew, would have been brought to them from the airplane as "freight" rather than by an Honor Guard. Matthew was rendered honors in Dover, Del., but the Holleys also expected to see that when his remains were transported from there. Under the law, the remains will be transported to the closest military base to the family's home. The fallen soldier will be rendered honors by an Honor Guard unless otherwise directed by the next of kin. "It should have been standard operating procedure," John said. "It shouldn't have been something we had to worry about." The Holleys, both veterans, don't want what happened to them to happen to other families of fallen soldiers. Sometime Sunday or early Monday transport officers whisked the convicted triple kidnap-murderer to the Idaho State prison in Boise. "Duncan, offender No. 83655, arrived today at the Idaho Maximum Security Institution located south of Boise, at approximately 10:30 a.m. (MDT)," said state corrections officials. "It's good to have him out of here and be rid of a high-profile inmate," said sheriff's Capt. Ben Wolfinger. State officials said the move went off without incident. Duncan, a 43-year-old level III registered sex offender, pleaded guilty last Monday and was sentenced to three consecutive life terms without parole for kidnapping. Prosecutors who sought the death penalty said that the capital penalty phase for the murder convition might be held if federal officials fail to get a conviction or death sentence for kidnapping two siblings after the Wolf Lodge killings on May 16, 2005. Officials said Duncan will be held in isolation, at least for the time being. On Friday, authorities said Duncan fulfilled part of his plea deal by meeting with investigators about the Wolf Lodge kidnap and bludgeoning deaths of Brenda Mathhews Groene, 40 and her son, Slade Groene, 13, and Mark McKenzie, 37, with a claw hammer . "Duncan gave investigators detailed information that was consistent with the physical evidence that had been collected at the scene of the murders," Wolfinger said. "Duncan's statements confirm the conclusion of investigators that he acted alone during those crimes." Wolfinger said specifics of the interview will not be able to be released until the federal case is concluded. "Every question they asked he answered to their satisfaction," said Duncan's federal defender Roger Peven, who, along with his state lawyer, Public Defender John Adams, stayed with their client during the hours-long interview. "My impression was he satisfied that condition to the letter." Adams declined to comment about Duncan's move. One condition of the plea bargain was he would talk about the Wolf Lodge killings, but not the kidnapping of youngsters Shasta and Dylan Groene, any criminal activity during their captivity or Dylan's shotgun death. Steve Groene, whose daughter, Shasta, was the lone survivor of the killings and kidnappings, said he really hadn't thought about his feelings on Duncan's move. "Is it easier with him out of the area?" Groene said. "I never thought about it one way or the other.' "Just so long as he's locked up," he said. In an earlier plea deal, Duncan had offered to admit to Dylan's killing as well and speak to any law officers designated by the state. Kootenai County Prosecutor Bill Douglas rejected that offer, instead, holding out for a death component. Peven said Duncan will likely remain in prison until he's indicted on the federal charges. Duncan pleaded guilty to 3 counts of kidnapping and 3 counts of murder on Monday morning.� A judge immediately sentenced him to three terms of life in prison without parole on the kidnapping charges.� Sentencing on the murder charges were delayed pending the outcome of Duncan's federal trial. Captain Ben Wolfinger with the Kootenai County Sheriff's Department said the 14-section plea agreement is different from the proposal floated last week by the defense.� By delaying sentencing on the murder charges, it Duncan is not sentenced to death by the federal government, the State of Idaho can retain him and possibly sentence him to death on the state charges. Brenda Groene's mother, Darlene Torres, was also pleased with the outcome of the agreement.� "I'm glad we're getting this first step over, and hopefully the rest of it goes quick," said Darlene Torres.� "There's nothing that's going to bring my family back, but I know justice will be served." But while many, including�Darlene Torres, believe Monday's outcome was a victory for Shasta, the family was clearly uncomfortable sitting in the same room with the man who killed their loved ones. Prosecutors say he stalked and killed family members to take the children. Feds to seek death for Duncan Posted: Tuesday, Oct 03, 2006 - 11:09:02 pm PDT By DAVE TURNER Staff writer Shasta's lawyer says death case in Idaho not needed now COEUR d'ALENE -- The lawyer representing Shasta Groene said there's no reason for the 9-year-old to testify in a state court now that federal prosecutors have been given the go-ahead to seek the death penalty against Joseph Edward Duncan III. John Sahlin, a Coeur d'Alene lawyer appointed by the federal courts, said Tuesday the state's case against Duncan could end short of a death sentence. "With the U.S. Attorney General's announcement, it is now my hope that there need be only one trial of Joseph Duncan," said Sahlin.Earlier, Idaho U.S. Attorney Tom Moss announced his office had been given permission by the Justice Department to seek the death penalty against Duncan. Duncan's federal defender, Roger Pevin, could not be reached for comment. Jury selection for the month-long state trial for Duncan is scheduled to begin Oct. 16 in 1st District Court. Duncan's lawyer, Kootenai County Public Defender John Adams, would not comment about whether the latest move would change the complexion of the state case. Adams previously said his client was willing to plead guilty, so long as he could avoid a death sentence. Kootenai County Prosecutor Bill Douglas said the fact the U.S. Attorney's Office can now seek death in the event of a federal court conviction changes nothing. "We're still going ahead," Douglas said Monday night. Douglas has continually stressed that the two cases -- state and federal -- involve two distinct and different elements. Douglas is seeking the death penalty if Duncan is convicted of the bludgeoning death of Brenda Kay Matthews Groene, 40, her 13-year-old son, Slade Groene, and boyfriend Mark Edward McKenzie, 37, at their Frontage Road home near Wolf Lodge Bay on May 16, 2005. Kootenai County Sheriff Rocky Watson said he was also in favor of the trial going ahead. "The citizens of Kootenai County were also Duncan's victims," he said. "The trial should be here." He said if convicted, Duncan deserves to die. "This way, you will have two shots at death because Duncan is evil," Watson said Tuesday. Meanwhile, the federal case begins where the Wolf Lodge killings end. Authorities said Shasta Groene, then 8, and her 9-year-old brother, Dylan, were taken by Duncan from their Wolf Lodge home to a remote campsites in the Lolo National Forest in Montana. The federal charges will likely stem from the kidnapping of the children, their transportation across state lines and the gunshot killing of Dylan, whose remains were found days after Shasta was rescued from Duncan at a Coeur d'Alene restaurant on July 2, 2005. Moss said Duncan would also likely face child pornography charges, as well as sexual abuse charges in the case. And after the federal case, Duncan still could face first-degree murder charges in the death of a California boy a decade ago. Ingrid Wyatt, a spokeswoman for the Riverside County District Attorney's Office, said prosecutors are waiting until Duncan's cases in Idaho are finished before filing charges in the death of 10-year-old Anthony Michael Martinez. Duncan has confessed to bashing the boy's head in with a rock in April 1997, then leaving his nude, sexually abused body in the rural Indio desert. "We're still planning on reviewing the case when our turn comes up," Wyatt said. Shasta's father, Steve Groene, who is recuperating from a larynectomy in a Seattle hospital, has supported the plea deal to save his daughter from having to testify. His support of that deal has met with opposition from other family members. McKenzie's mother, Lee Wood, said after meeting with Douglas on Monday, family members still support Douglas' decision to go ahead with the first trial. "We thought about it and talked to Bill Douglas yesterday," Wood said Tuesday. "I don't care if (Duncan) is given the death penalty in the state or the federal court, but I still want the state's trial to go ahead. "What if he gets a life sentence in federal court," she said. "This way we have a double chance of a death penalty." Brenda Groene's mother, Darlene Torres, agreed. "There is nothing that's going to bring the family back," Torres said. "It's between the state and federal government at this point." But County Commissioner Rick Currie said aside from the cost, holding two trials is superfluous and could put many people through unnecessary pain. "I am disappointed in the decision to go ahead" with the state trial, Currie said. "It's going to cost a lot of money and it's going to be redundant." He said the trial will cost about $1 million. Currie won't say what reasons Douglas might have for continuing with the state's case. "I have my opinion why (Douglas wants to go ahead) and as much as I want to say it, I can't." Currie said it's doubtful that Idaho's death row for Duncan would be much different than if he were sentenced to life without parole. "The state of Idaho cannot kill him," Currie said. "The case will go through 20 years of appeals." He noted the case of Donald Paradis, who was freed after 20 years on death row when an appeals court determined the state erred during the prosecution. Once released, the county settled a lawsuit short of trial for $900,000. "Do I want to see this guy die? Yes," Currie said. "I think everybody does. And the feds will do a good job." In the past, Adams had sought an arrangement for his client to plead guilty to the Idaho charges, so long as Duncan received life without parole. Coeur d'Alene defense lawyer Mike Palmer, who is not connected to the Duncan case, said he didn't know how Duncan would benefit from any plea deal which would still allow other jurisdictions to charge him. Palmer said generally with plea bargains, that means settling for a lesser sentence in one jurisdiction, no matter what happens elsewhere. "It's the client's decision," Palmer said. "In this case, if there is any offer to accept, ultimately it's up to Duncan." The next step is for federal prosecutors to take their evidence to a grand jury and seek an indictment. No time frame for that empanelment was immediately released.

National Fraternal Order of Police Board Report Of National President Chuck Canterbury Salt Lake City, Utah September 8-9, 2006 The National Fraternal Order of Police has been very active in the period since the March 2006 Board meeting. In an effort to maintain continuity in my reports to the Board, this report will be broken down into four areas: Due to the many activities of my office, this report will highlight the major components of the office of the President. Legislative Administrative Labor Activity Calendar Legislative: The mid term election cycle has begun and many Lodges are involved in the endorsement of candidates for office. During this period, I have answered a number of calls for information on the National's perspective on various candidates. The National Legislative Office can and should be contacted in order to provide you with the voting record on your incumbents and the office can provide you a well prepared questionnaire on the issues of interest to the Fraternal Order of Police. During the period of time since the March Board meeting, the FOP has had a number of achievements on Capitol Hill. I think one of the most significant wins was actually a loss of Cynthia McKinney from the United States House of Representatives. As you know, McKinney struck one of our members while he was performing his duties as a Capitol Police Officer and after a long and protracted presentation to the DC Grand Jury which resulted in a vote against indictment, a campaign was launched by the FOP to assist in helping Candidate Hank Johnson unseat McKinney. I want to thank DC Lodge 1, the Capitol Police Labor Committee, The Dekalb County FOP, the Georgia State Lodge and the National Legislative office for working together to make this a reality. The Local Lodge endorsed Hank Johnson in a Primary, the Georgia State Lodge affirmed their support of Johnson and the National PAC fund made a donation to Mr. Johnson's campaign. The FOP conducted dozens of interviews with local and national media outlets and we were recognized as one of the groups that played a major role in Johnson gaining ground in the original Primary. These efforts where successful and McKinney was defeated in the August 8th run off election. This was a concerted effort and I am proud of the membership for all of their hard work. In May of this year, the National FOP took a strong position of support for a resolution introduced by Pennsylvania Representatives that condemned the actions of St. Denis France naming a street for convicted Cop Killer, Mumia Abu-Jamal. As National President, I traveled to Philadelphia and participated in a protest march at the French Consulate on Bastille Day. Philadelphia Lodge 5 is to be commended for their continued support of the Faulkner Family and to Danny's memory. On May 23rd, the National FOP took a strong stand on the efforts to retry two cop killers in Nebraska and we joined with the Nebraska State Lodge condemning the effort to win a new trial for these convicted offenders. In June of this year, the National worked hard to obtain passage on an amendment that would restrict the implementation of the NSPS system by the Department of Defense. This system will be detrimental to our officers in the DOD system and this bill passed the House and we continue to work to see that this bill passes the Senate and stops this system from having an effect on our members. The FOP scored a major victory when the Senate Passed H.R. 4 the Pension Protection Act of 2006. This bill will eliminate the ten percent early withdraw penalty from a government defined benefit plan for public safety officers who are participating in a DROP plan. Under the previous law, an officer who leaves active service before the age of 55 and opts to receive a lump sum payment under DROP before the age of 59 � is subject to an early withdraw penalty of 10%. The bill also included the HELPS provision which provides a tax benefit to help retired public safety officers afford health insurance by allowing the use on a pre-tax basis of up to $3,000 annually from their pension funds to pay for premiums on health care and long term care insurance. The FOP supported and worked very hard to pass this bill. The FOP also worked hard to restore funds to the budget to Byrne Grants programs and we were successful in assisting to get a $120 million dollar net increase over the FY 2006 budget. The FOP Political Action Committee (PAC) made several donations to key congressional partners but we still need your help in raising funds to make our PAC the force that it should be. Please donate today if you have not and I urge the leadership to continue to work to increase our funding for this vital part of our legislative program. During the months since the past Board meeting, I have traveled to DC on a number of occasions and have had daily contact with the Legislative office and the fruits of our labor have indeed been productive. The National Staff does tremendous work and I hope that you will thank them for their efforts. Administrative: The National Administrative office located at 701 Marriott Drive, Nashville TN, has opened and I am sure that Secretary Yoes will provide a more detailed report but I am proud to say that the building is a vast improvement over our last accommodations and we own this one and it is paid for. The National Board is to be commended for this forward thinking and I want to thank everyone involved for this achievement. I especially want to thank the staff for all of their hard work in making the move. After eleven years in one location, it was a monumental task to pack up and move and the staff did an outstanding job in making this happen. The National Executive Board will be conducting an Employee Compensation Study to ensure that the National pay structure is in line with our peers in the market and we will be working in conjunction with Middle Tennessee State University to complete this project. The National Lodge has also been working on a program to ensure that our employee health insurance program is the best that we can provide and we are working with several companies and accepting bids on health insurance polices. Currently our employees do not contribute to this plan and it is our desire to continue this benefit and we are dedicated to providing the best benefits that we can afford. We have been able to increase the life insurance coverage for our employees for just pennies more a month, we are providing $25,000 coverage and also providing coverage on their spouses and dependant children. This is an added benefit and the National pays the entire cost for our employees. The DC Office location needed some cosmetic repairs and these have been authorized and the work is underway. This building has appreciated to almost five times what we paid for it only 11 years ago and we must make sure that we maintain the facility. Jan Gross must be commended for working hard to keep our costs down and I want to thank her for her hard work in this area. The massive computer project is almost finished and by the time of the Board meeting, it should be up and running. This project has been very tough and has frayed nerves, caused ulcers and strained our staff but it will provide us state of the art software and will benefit our membership. All parties involved are to be commended for this wonderful addition to our arsenal of weapons in the battle to provide better member services. The FOP Disaster Relief fund has again been called to action this time by the floods that plagued the North Eastern States in early summer. The Bloomberg Police Department, Bloomberg PA, suffered substantial damage and many of the officers in that area had damage from the floods. I want to thank Gall's for donating 34 sets of BDU's for the Bloomberg Police Department and I am proud to report that the National was able to provide several officers with $500.00 donations to assist them in this time of need. The effort was coordinated by the State Lodge and our system worked well. We continue to struggle with Trademark issues and I encourage you all to report violations to National Secretary Yoes when you find them so we can protect our name. The National FOP RHS program has seen some growth and we continue to work with ICMA to provide them the ability to assist Lodges in implementing programs to benefit our members. The 457 Program has been slow but we are picking up units and this very important FOP owned program needs your support. A report will be provided during the Board meeting on these programs. National Treasurer Penoza and I continue to work on the FOP Bank and we will report our findings as soon as we can but this is a very complicated issue and we must move with slow but deliberate speed in order to protect our interests. Labor: The National Labor Services Director will provide a detailed report on the activities of this section but in an effort to make sure that the important matters are detailed for your review, I offer the following: We continue to work to make sure that the Teamsters and other groups do not find fertile ground to recruit within the FOP family. We are monitoring and working with the Nashville FOP and we have worked with Little Rock in their successful effort to keep the Teamsters out of Arkansas. We have had successful campaigns against the Teamsters in Pennsylvania, Ohio, and South Dakota and these efforts will continue. The National Lodge has had requests from several cities to assist in efforts to decertify their current unions and we are working with them to provide the necessary professional services. During this meeting, the National Labor Committee, pursuant to a motion of this Board, will provide a report on the continuing efforts to expand Labor Services. I urge you each to read this proposal very carefully as it will greatly expand our current program. The committee worked very hard to generate this report and your full attention will be required to make sure that we are moving this organization forward. The Labor Services Section continues to work with the Arizona State Lodge and Lodge 32 in their effort to win the bargaining rights for the Arizona Department of Public Safety. This effort will culminate in an election in November of this year. The National Lodge will again offer the Collective Bargaining seminar in April of 2007 and I have worked with the Education Services Committee to keep the costs in line and to provide the best training we can at a reasonable price. I urge all of the Trustees to make sure that your Lodges are made aware of all National Training opportunities. The Committee will be providing the Blueprint for Success Seminar in Louisville Ky November 9-11, 2006 and I urge you all to get this information out to your locals. On the Federal Sector, I have already reported on my activities working with Capitol Police on the McKinney issue but I did not report on the fact that I traveled to DC and met with many members of this unit to first and foremost let them know that the National FOP was supporting them in their hour of need but to also bring the issue to light. We received a lot of media coverage and the Capitol Police Labor Committee is to be commended for their tireless effort to maintain morale and efficiency at the same time. I recently attended an Arbitration with the Pentagon Police and we are working with the Administration on ways to assist this Labor Committee of DC Lodge. A number of meetings have been accomplished and we will continue to work hard to assist these officers. I have daily contact with the Labor Services Director and we discuss every aspect of this office and I will continue to work to improve on our ability to deliver Labor Services to our members. ALERT!! FEMA WANTS TO RUIN ANOTHER DEPARTMENT! IMPORTANT READ!!

LEGISLATIVE ALERT: DHS Spending Bill!!! ��The House and Senate appropriators and authorizers have stripped out a very important law enforcement provision from an amendment which would reauthorize and fund the U.S. Department of Homeland Security. In its current form, funds which previously flowed through the Department to law enforcement would be redirected to the Federal Emergency Management Agency (FEMA), effectively making law enforcement answerable to FEMA. ��The FOP will not support the spending bill in its current form, which is slated to be acted on next week. We are asking all FOP members to contact their Senators and Representative and ask that they not support the DHS spending bill unless the law enforcement provisions are restored and that law enforcement grants are kept outside of FEMA. TEDDY KILLS 2,500!!! :-O

Killer teddy bear leaves 2,500 fish dead Associated Press MILFORD, N.H. - A teddy bear has been implicated in 2,500 deaths. Of trout, that is. State officials say a teddy bear dropped into a pool at a Fish and Game Department hatchery earlier this month clogged a drain. The clog blocked the flow of oxygen to the pool and suffocated the fish. Hatcheries supervisor Robert Fawcett said the bear - who was dressed in yellow raincoat and hat - is believed to be the first stuffed bear to cause fatalities at the facility. "We've had pipes get clogged, but it's usually with more naturally occurring things like a frog or even a dead muskrat," he said. "This one turned out to be a teddy bear and we don't know how it got there." The deaths prompted Fawcett to release a written warning: "RELEASE OF ANY TEDDY BEARS into the fish hatchery water IS NOT PERMITTED." He said it's not known who dropped the bear, but urged anyone whose bear ends up in a hatchery pool to find a worker to remove it. "They might save your teddy bear, and keep it from becoming a killer," he said. Judge suspends law aimed at stopping military funeral protests By BRETT BARROUQUERE Associated Press Writer LOUISVILLE, Ky. � Kentucky's law forbidding protests within 300 feet of military funerals and memorial services was suspended temporarily Tuesday after a federal judge ruled it was too broad. The law passed earlier this year was aimed at members of a Topeka, Kan., church who have toured the country protesting at military funerals. The Westboro Baptist Church claims the soldiers' deaths are a sign of God punishing America for tolerating homosexuality.� Members of the church traveled to Montana in August to stage a protest at the funeral of Marine Cpl. Phillip E. Baucus, the nephew of U.S. Sen. Max Baucus. U.S. District Judge Karen Caldwell wrote that the law could restrict the free speech rights of people in nearby homes, sidewalks and streets, even if they cannot be seen or heard by funeral participants. The 300-foot zone "is large enough that it would restrict communications intended for the general public on a matter completely unrelated to the funeral as well as messages targeted at funeral participants," Caldwell wrote in a ruling issued in Frankfort. Those found guilty of violating the law, which also applies to memorial services, wakes and burials, would face up to a year in jail. About a dozen states have similar laws in place, and Congress passed a law earlier this year prohibiting protests at military funerals at federal cemeteries. Kentucky Attorney General Greg Stumbo said he would consider an appeal. "I believe that society has an interest in honoring its war dead. Funerals are times of sacred and solemn reflection which must be protected from aggressive disruption," Stumbo said in a statement. Lili Lutgens, general counsel for the American Civil Liberties Union of Kentucky, which filed the suit, said Caldwell "reinforced the importance of freedom of expression," and that the ACLU will seek a permanent injunction throwing out the law. "We continue to support the commonwealth's efforts to protect funerals, but we know it's not necessary to violate the First Amendment to do that," she said. Shirley Phelps-Roper, attorney for and member of Westboro Baptist Church, praised Caldwell's ruling. "I'm surprised, but I'm happy about it," Phelps-Roper said. The ACLU filed the lawsuit on behalf of Bart McQueary, a Mercer County man who has protested alongside the church members on three occasions. During their protests, members carry such signs as "Thank God for IEDs," the improvised explosive devices used by insurgents in Iraq.

Chapman, son Leland Chapman and associate Timothy Chapman were taken into custody and did not resist arrest, said Mark Hanohano, U.S. Marshal for the district of Hawaii. "It went down without incident," Hanohano said. Mona K. Wood, a publicist for the star of the popular cable series "Dog The Bounty Hunter," said Chapman would be vindicated. "He arrests the bad guys - and he is definitely not one of them," she said. The charges stem from Chapman's capture of Max Factor heir Andrew Luster on June 18, 2003, in Puerto Vallarta, Mexico, said Marshals spokeswoman Nikki Credic in Washington. Chapman's capture of Luster, who had fled the country after being convicted of raping three women, catapulted the 53-year-old bounty hunter to fame and led to the reality series on A&E. The three are being held in Honolulu. Bail has not been set. They will face an extradition hearing to Mexico under terms of treaties between the U.S. and Mexico, Credic said. Chapman's son Leland, 29, and Timothy Chapman, 41, no relation, assist Chapman in exploits chronicled for the TV show around the Hawaiian Islands. The show focuses on Chapman's family as much as the bounty hunting, which generally involves tracking down bail jumpers, often creating emotional scenes with repentant captives. Charges have been pending against the three since local police in Mexico arrested them shortly after they roped in Luster. They posted bail but never returned to Puerto Vallarta for their court hearing on July 15, 2003, Credic said. Mexican authorities demanded that the Chapmans transfer Luster to Mexican police. Their refusal to do so led to their initial arrest. A U.S. warrant for their arrest was signed by a federal judge in Honolulu on Wednesday.
